1. Preamble
These General Conditions of Sale are concluded between

2- Definition
The following definitions apply in these general conditions of sale according to the meaning indicated below (whether used in the singular or in the plural).
• "General Conditions of Sale": refer to this document, ie the terms and conditions applicable in the relationship between HeiwaPottery and the Customer.
• "Order": refers to the Customer's purchase order for one or more Product (s) made by using the Website.
• "Site": refers to the website accessible at the address www.heiwapottery.com, published by HeiwaPottery.
• “Product”: designates a product offered for sale on the Website, on the day of consultation of the site by the Customer. Our product offers and prices are valid as long as they are visible on the Site, while stocks last. 7- Product characteristics and prices

The photographs of the products presented on the Site are as accurate as possible but cannot ensure a perfect similarity with the products offered.
7.2. Product availability and validity of the offer
A product that has become unavailable is indicated with the mention: "OUT OF STOCK". It is also specified that the mere fact of adding a product to the basket does not constitute validation of an order. In other words, the product may become unavailable between the time of addition to the basket and the validation of the order by the Customer. In the event that the unavailability of the product or service is found after validation of payment, HeiwaPottery undertakes to cancel the order and fully refund the price paid by the Customer. In this case, the refund will be made without delay and at the latest within fourteen (14) days of payment of the sums paid by the Customer.
7.3. Price
The prices of the products and services presented on the Site are indicated in Euros, all taxes included (TTC). They are applicable during the validation of the order by the Customer and do not include the participation in the transport and packaging costs, invoiced in addition and indicated on the "Summary" page of the basket before the final validation of the order. Prices inclusive of all taxes are understood to include VAT (Value Added Tax) for products delivered within the European Union. Items subject to VAT are subject to French VAT. Any change in the legal French VAT rates will be reflected in the price of the products and services presented on the Site, on the date stipulated by the relevant implementing decree. Regarding sales made outside the European Union, customs clearance, payment of various duties or taxes are the sole responsibility of the Customer.
8- Payment
All prices shown are inclusive of VAT. The total amount of an order is made up of the price of the items and the shipping and packaging costs. The Customer can use the following payment methods: VISA, MASTERCARD. If the payment is refused by the authorization center, HeiwaPottery will not be able to ship the order.
9- Order confirmation
The Customer will receive a confirmation email as soon as HeiwaPottery receives your order. The references of this email must be ready for all correspondence. If the Customer does not receive this confirmation email, he must contact heiwapottery@gmail.com.
10- Right of withdrawal
In accordance with article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the products to exercise his right of withdrawal, without having to justify reasons, nor to pay penalties with the exception, where applicable, of return costs. Returned products must not have been used.
The period of fourteen (14) days runs from receipt of the products: when the period of fourteen (14) days expires on a Saturday, Sunday or a public holiday, it is extended until the next working day. HeiwaPottery recommends that Customers who wish to exercise their right of withdrawal inform Customer Service by email at heiwapottery@gmail.com.
11- Delivery
11.1 Delivery costs
The delivery costs dedicated to HeiwaPottery online sales site have been established according to the volumes and weight of the product according to the current rates of the post office and carriers.
11.2 Delivery times
Unless otherwise stated on the site, HeiwaPottery will make its best efforts to ensure that the order is shipped within an average of 7 days after confirmation of the order. If one or more items are no longer available without this being indicated in the product sheet, the Customer is notified by email or telephone and HeiwaPottery will reimburse these items by crediting the card used to pay for the order. If the workshop is closed, a pop-up message will warn of the reopening date and deliveries will resume from that date.
12- Product return conditions
The Customer has a legal period of fourteen (14) days from the day of receipt of his order to notify HeiwaPottery of his intention to return the product to us and the reason for this return.
The return of the product (s) is made in their original packaging, accompanied by all possible accessories, in perfect condition for resale, with the indication of the order number to which the products relate. . The product must be returned in packaging provided for this purpose, which does not allow identification of the product (postal parcel, bubble envelope, kraft paper, etc.). Any product that is damaged, incomplete, absent or whose original packaging has been damaged will not be refunded or exchanged and will be returned to the Customer. HeiwaPottery recommends that the Customer return their products with a recommendation or additional insurance guaranteeing, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the product. or packages.
The costs are the responsibility of the customer.
13- Refund
In the event of the exercise of the right of withdrawal, HeiwaPottery is required to reimburse the Customer for the sums it has paid, without penalty, with the exception of shipping costs. The refund is due without delay and at the latest within fourteen (14) days following the date of receipt of the returned products. If the return of the purchased product (s) is due to an error on the part of HeiwaPottery, then the shipping and return costs will be fully refunded to the Customer.
14- Cancellation
Beyond this withdrawal period, if the Customer wishes to cancel his order he must contact heiwapottery@gmail.com. If his order has been dispatched, HeiwaPottery will ask the Customer to return the products by following the instructions given by email.
15- Modification of order
If the Customer would like to make any changes to his order, change the delivery address, or add products, he must contact us by email heiwapottery@gmail.com.
16- Guarantees
16.1. Transport guarantee
Assuming the risks associated with transport, HeiwaPottery undertakes to deliver the products ordered by the Customer in closed, resistant packaging appropriate to the content and the transport requirements. Any product damaged or lost in transit will be replaced. The transport guarantee is valid only if the Customer or his Recipient has signed the delivery slip or transport receipt presented by the carrier on which he will have taken care to issue precise, dated and signed handwritten reservations. By signing the delivery slip or the transport receipt, without making any reservations, the Customer acknowledges that his package was not damaged during transport. In the event of a dispute, the original packaging must be kept until the dispute is resolved. HeiwaPottery advises the Customer or its recipient to inform HeiwaPottery by email heiwapottery@gmail.com within a maximum of 48 hours from delivery, after this period no complaint will be taken into account.
16.2. Customer complaint
Enforcement of warranties should be requested by email to heiwapottery@gmail.com. The complaint must be justified and accompanied by supporting documents for the damage suffered (photos, etc.). The Customer must also indicate whether he wishes the replacement of the product or its refund.
The photographs of the products presented on the Site are as accurate as possible but cannot ensure a perfect similarity with the products offered. As each part is made by hand, it is normal that there are variations between the parts. In addition, since the enameling is carried out by immersing the dishes in an enamel bath, it is normal for the dishes to have enamel drips, the color of which may vary depending on the thickness of the enamel.
NB: complaints or disputes will always be received with attention, good faith being always presumed in those who take the trouble to expose the dispute.
17- Applicable law
The General Conditions of Sale are subject to French law. In the event of disputes, the Customer may make their complaints to HeiwaPottery by email at heiwapottery@gmail.com in order to seek an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, which have sole jurisdiction in the matter.
